Terms of Use and Privacy Policy
For the Instawear Fitting Room, on stores' websites and in the Instawear app.
These are the terms you agree to before you upload a photo, the same ones shown in the Fitting Room and the app. Where they say the store, they mean the store whose Fitting Room you're using: the app shows its name in their place. For the short version, see how we protect your photo.

About the Virtual Fitting Room
- The Virtual Fitting Room lets you see how the store's pieces might look on you. You upload one photo of yourself, choose pieces, and an AI model creates an image of you wearing them. An AI Stylist can suggest pieces and complete a look, and you can chat with it about styling.
- The Fitting Room is provided to the store by Instawear. These terms explain how you may use it and how your information is handled. By ticking the boxes before you upload a photo, you agree to them.
Who can use it
- You must be 18 or over.
- Only upload a photo of yourself that you're authorised to use. Don't upload photos of other people, of children, or of well-known people.
- You can try pieces on with a profile (you sign in with your email address) or, where the store offers it, as a guest without an account.
- There's a daily limit on try-ons. It is shown on your looks and may be lower for guests.
How it works
- Your photo is checked by AI before it's used: that it's suitable (no nudity, no one under 18, no well-known people), that it shows one person facing the camera, and that it's clear enough for a good try-on. The check also finds your face, upper body and full body so each try-on uses the right part of your photo.
- When you try pieces on, your photo and the product photos are sent to the AI model, which creates your look. Every image is checked again before you see it: if it doesn't look enough like you or the pieces didn't come out like the real ones, it isn't shown and doesn't count towards your daily limit.
- A look can have up to 5 of the store's pieces. You can save, download or share your looks, and ask the AI Stylist about them.
Getting a good result
- Use one clear photo of just you, in good light, against a plain background.
- For full-length looks, show your whole body from head to feet, standing and facing the camera (a slight turn is fine), in everyday fitted clothes.
- Avoid photos taken very close up or from far away, sitting or crouching, or with your hands or body hidden.
What you mustn't do
- Upload nudity, sexual content, or images that are hateful, violent or otherwise harmful.
- Upload anyone else's photo without their permission, or any photo of a child.
- Try to make the Fitting Room produce misleading, offensive or harmful images, or use it to impersonate someone.
- Use automated tools to access the Fitting Room, or try to get around its limits or checks.
- We may refuse a photo or an image, and may stop you using the Fitting Room if these rules are broken.
About the images you see
- Try-on images are AI-generated approximations. They may get details wrong, such as your body shape, your features, or a product's colour, fit or details.
- They are not a size guide and don't show how a piece will actually fit. Always check the store's size charts and product details before you buy.
- AI Stylist suggestions may not always be right. Ask for a person in the chat any time, where the store offers it.
What we collect and why
- Your photo, and any extra photos you upload for a view, to check them and create your try-ons.
- With a profile: your email address, to sign you in and keep your photo and looks across devices. You can change it on your profile.
- Your looks: the pieces you tried, the images created, and whether you saved them.
- Optional details you choose to add: your sizes and shopping preference, and your skin tone, hair colour, eye colour and undertone. If you ask, AI suggests these colours from your photo, and you can change them. Your sizes are used to suggest your size and to find pieces in your size, and your shopping preference to show you womenswear or menswear. Your colour details are only used so the AI Stylist can choose colours that suit you (with enough of them, your colour season). None of them is used for marketing, and you can choose "Prefer not to say" for each.
- With a profile: your AI Stylist learns your taste from what you do at every store you use: looks you like, share, save or delete, pieces you add to your bag or take out of a look, what you buy and return, and your answers to the style quiz. It keeps a few notes about your taste and a list of pieces you bought through looks and kept, and uses them only to suggest looks you're more likely to like. This is automated personalisation: it isn't used for marketing, prices or any decision about you, and stores can't see your notes.
- Notes you add yourself, or keep from a chat with the AI Stylist ("Remember"), are kept with your profile and checked by AI to make sure they're about your clothes and style.
- To check that personalisation helps, about 1 in 10 shoppers, chosen at random, get suggestions that don't use what the AI Stylist has learned. Notes you wrote or kept are still used.
- Your approximate location (the city your internet connection is in, not your device's location), each time you use the AI Stylist, so it can suggest clothes for the season and weather where you are. It isn't kept. If you mention a trip or an occasion, the AI Stylist looks up the weather for that place and date.
- How you use the Fitting Room (for example which pieces you try or add to your bag), so the store can see what works and improve its range and the service.
- With a profile: whether you went on to buy a piece you tried on, and whether you returned it, so the store can see which looks lead to sales and fewer returns. Where the store sells through Shopify, we match its orders to your profile by your email address, and link your profile to your customer account with the store that has the same address.
- With a profile: how pieces you bought from a look fit, from what you tell us and what your orders show (a piece swapped for another size, returned as too small or too big, or kept), so we can suggest your size at that store next time. You can see it, change it or forget it on your profile.
- As a guest: your photo and looks stay on your device, in your browser.
- Chats with the AI Stylist are kept for up to 30 days, to improve the quality of its answers. Where the store has turned it on, its team can also read your chats with its AI Stylist on its website: the chat tells you so when it begins. We don't keep who you are with them, so please don't share sensitive information.
- If our quality check refuses an image made for you with a profile, that image and the photo it was made from may be kept for up to 30 days so Instawear can see what went wrong and improve the Fitting Room. Guests' refused images aren't kept.
Your photos, AI and your face
- The photos you upload and the try-on images made from them are never stored by an AI model, and never used to train AI models, now or in the future.
- Your photo is only used for the Fitting Room. We don't create or keep facial recognition templates, and we don't use your photo to identify you.
- Your photo isn't sold or shared for advertising.
Who handles your information
- The store: provides the Fitting Room on its website and can see profiles, looks and usage in its dashboard. It sends you app notifications only if you turn them on. Instawear never signs you up to the store's marketing emails.
- Instawear: runs the Fitting Room for the store, and may review refused images and chats to improve quality. Instawear uses a third-party LLM provider to check photos, create try-on images and power the AI Stylist.
- If you ask to talk to a person, your look and the conversation are passed to the store's live chat service.
- Open-Meteo: provides weather forecasts. It receives only a place's name or rough coordinates, never your name, email or photo.
- Apple, Google and Shop (Shopify): if you choose to continue with one of them, it tells Instawear your email address, your name if you share it, and an ID for your account there, which we keep to sign you in next time. We never see your password there.
How long we keep it
- Your photo: until you delete it or your profile.
- Looks you haven't liked: deleted after the period the store sets (7 days unless it chooses otherwise, up to a year).
- Liked looks: deleted after the period the store sets (90 days unless it chooses otherwise, up to a year).
- Chats and refused images: up to 30 days.
- Which pieces you tried on (no images), to match them to purchases: up to 90 days.
- What your AI Stylist has learned about your taste: until you start over or delete your profile.
- Guests: on your device until you clear your browser, or start over on a new connection or browser.
Your choices
- Delete a look or a profile set, or replace your photo, at any time in the Fitting Room.
- Delete your whole profile, photos and looks in the Instawear app (Delete my data), or ask the store to do it.
- Turn off a store's app notifications at any time on the Stores screen in the Instawear app.
- See what your AI Stylist has learned, remove any of it, add your own notes, start over, or turn personalised suggestions off at any time, under "Your AI stylist" on your profile. Turning it off is how you object to this personalisation; you can also ask the store or Instawear.
- Ask the store for a copy of your information or to correct it.
Security
Your information is sent over encrypted connections and stored securely. Only authorised staff at the store and Instawear can see it.
